INTRODUCTION
These General Terms and Conditions of Sale govern the relationship between Mig’s World Wines, the department responsible for the sale of wines and spirits on the Internet within SRL Bales & Barrels, and any individual or legal entity placing an order via the Mig’s World Wines website (www.migs.wine), hereinafter referred to as “the customer”.

1. FIELD OF APPLICATION
1.1 Unless expressly agreed otherwise in writing, these General Terms and Conditions of Sale apply by right to any order for products or services placed by the customer on the Mig’s World Wines website, as well as to the articles and services presented on the site.
1.2. Before placing any order, the client acknowledges having read the General Terms and Conditions of Sale. Confirmation of the order by the client on the Mig’s World Wines website constitutes full and complete acceptance of the said Conditions.
1.3 Mig’s World Wines reserves the right to modify its General Conditions of Sale at any time. In this case, the Conditions that prevail are those that exist at the date of the order by the client.
1.4. Should any provision of the General Terms and Conditions of Sale become invalid, the other provisions will remain in force.
1.5. Cases of application not provided for in these General Terms and Conditions of Sale shall be governed by the practices in force in the Belgian Internet sales sector.
2. ORDER
2.1. All orders are placed exclusively on the Mig’s World Wines website, the address of which is mentioned above.
2.2. The offers remain valid within the limits of available stocks. Although the seller does everything in its power to have adequate stocks, it is possible that it may occasionally not be able to satisfy the order. If this is the case, the seller will notify the buyer by telephone or e-mail.
2.4. The customer is obliged to provide full contact details as indicated on the order form. Mig’s World Wines reserves the right to refuse an order that does not include the customer’s full contact details.
2.5. The sale is only considered final after Mig’s World Wines has sent an email to the client confirming the acceptance of the order, indicating that the payment of the order by the client has been accepted. The acceptance of the order is therefore subject to the full payment of the order. For the terms of payment, please refer to point 4 below.
2.6. Mig’s World Wines reserves the right to refuse any order from a customer with whom there is a dispute regarding a previous order or any other dispute.
2.7. Mig’s World Wines reserves the right to limit an order in the event that stocks are insufficient. If Mig’s World Wines is unable to execute the order, for whatever reason, the client will be informed as soon as possible, without the client being able to claim any compensation. In this case, Mig’s World Wines undertakes to reimburse the customer in full (or in part, depending on the case).
3. PRICES
3.1 All prices on the Mig’s World Wines website are valid on the day the customer consults the site. They are subject to change without notice.
3.2. Prices are expressed in euros, including all taxes and excise duties. Unless expressly stated, prices exclude delivery costs. For delivery conditions, please refer to point 5 below.
3.3. Although Mig’s World Wines makes every effort to ensure that the prices of products/services and delivery costs are correct, errors can always occur. In this case, Mig’s World Wines cannot be obliged to deliver the product or provide the service at the price indicated. Mig’s World Wines undertakes to inform the customer as soon as possible, who will then be free to cancel the order.
3.4. Prices, promotions and special conditions are those in force on the date the order is placed.
4. TERMS OF PAYMENT
4.1. All orders are payable in cash, in full, at the time the customer places the order. Payments are made exclusively in Euros. Mig’s World Wines will not be obliged to deliver the products ordered by the customer if this payment condition is not met.
4.2. Payment shall be made by one of the means of payment offered at the time of placing the order. Orders paid by bank transfer will be executed upon receipt of the amount due in the bank account of Mig’s World Wines.
5. DELIVERY
5.1. The delivery of the goods ordered is ensured by Mig’s World Wines. The goods are insured during transport by Mig’s World Wines.
The client also has the possibility to take delivery of the goods ordered at the Mig’s World Wines headquarters: chaussée de Charleroi 43, 1060 Brussels. In this case, no delivery costs are due. The customer must specify this when placing the order by choosing the “Pick up in store” option.
5.2. Delivery costs in Belgium vary according to the delivery method chosen by the customer. For more information on this subject, please refer to the “Delivery” section on the Mig’s World Wines website. For all orders over 200€, to a single address in Belgium, delivery is free.
For all orders to be delivered outside Belgium, delivery is made by post. The delivery costs are determined on the basis of the postal rates applied by Bpost, subject to the customer’s prior agreement. This agreement is presumed to have been given in the absence of any reaction to the contrary from the customer at the time of placing the order.
5.3. Except in cases of force majeure, the order placed by the customer shall be delivered in Belgium within a maximum of ten working days from the date of confirmation of payment of said order. This is an obligation of means and Mig’s World Wines cannot be held responsible for the payment of any compensation in case of late delivery. Insofar as possible, Mig’s World Wines will warn the client if the deadline cannot be met.
The order is delivered to the address indicated by the client at the time of placing the order. If all or part of the details are incorrect and prevent delivery (with the order being returned to Mig’s World Wines), the client will bear all the material (delay in delivery) and financial consequences (payment of delivery costs and any new delivery costs). Mig’s World Wines cannot be held responsible for the impossibility of delivering the goods at the right place and time in case of an error on the part of the client.
5.4. Mig’s World Wines reserves the right to change the delivery time or to split the delivery in case of unavailability of one or more products ordered. In this case, Mig’s World Wines will contact the client by e-mail, at the address mentioned in the order form, in order to agree on a later delivery date, a product substitution or a cancellation of the order.
5.5. If the delivery deadline is exceeded and not justified by force majeure, the customer must inform Mig’s World Wines by registered mail within 15 days. The client is entitled to request a refund of the order, to the exclusion of any other indemnity or compensation. After this period of 15 days, the client is no longer entitled to make any claim.
5.6. The delivery is considered effective as soon as the goods have been handed over to the customer by a representative of Mig’s World Wines, the customer’s signature on the delivery note being proof of this.
5.7. The customer is obliged to check the condition of the goods delivered, as well as their conformity (quantity and references) with the order form, at the time of delivery.
If the goods are damaged (broken bottles) and/or do not conform to the order (wrong quantity and/or reference number), the customer must formulate reservations on the delivery slip. In this case, the customer is free to accept or refuse the order. If the customer refuses the order, Mig’s World Wines will pay the return costs and replace the damaged or non-compliant product as soon as possible and at its own expense. If it is impossible to replace the damaged or non-conforming product, the client will be reimbursed accordingly. Mig’s World Wines cannot be held responsible for any defects or damage to the products or their packaging after delivery.
5.8. Mig’s World Wines only undertakes to take back and reimburse corked bottles, after a favourable opinion from its oenologist, within six months of the order. The article must be returned in its original packaging, which must be at least 90% full.
6. RIGHT OF WITHDRAWAL
6.1. In accordance with article 47 § 1 of the law of 6 April 2010 on market practices and consumer protection, the buyer has a withdrawal period of 14 calendar days from the day following the day of delivery to return, without penalty and without giving any reason, any goods ordered that do not suit him/her. The customer is obliged to inform Mig’s World Wines in advance in writing (letter or e-mail) of the exercise of his right of withdrawal. The direct costs of returning the goods are to be borne by the client.
6.2. The return must be made in the original, unopened and undamaged packaging (cardboard or wood). The parcel must be delivered in person to the Mig’s World Wines head office or returned by registered post to the following address: chaussée de Charleroi 43, 1060 Brussels.
6.3. In case of exercising the right of withdrawal, the customer will be reimbursed for the returned products, minus the initial transport costs and the value of the retained products, within thirty days.
7. SALE OF ALCOHOLIC BEVERAGES
7.1. As the law prohibits the sale of alcohol to minors, the customer undertakes to be at least 18 years of age on the date of the order.
7.2. Mig’s World Wines reminds the customer that the abuse of alcohol is dangerous to health and recommends that it be consumed in moderation.
7.3. Mig’s World Wines cannot be held responsible or liable for the payment of any compensation for damage that may result from the use or consumption of the products delivered.
8. PROTECTION OF PRIVACY
Mig’s World Wines (Bales & Barrels SRL) respects your privacy in the sense of the law of 8 December 1992 on the protection of privacy with regard to the processing of personal data. For more information on this subject, please refer to the “Privacy Policy” section of our website.
9. DISPUTES
The Mig’s World Wines website, as well as all acts arising from its use – including these general terms and conditions of sale – are subject to Belgian law.
Mig’s World Wines and the client will make every effort to resolve amicably any disputes that may arise from the application of these general conditions of sale.
In the absence of an amicable agreement, any possible dispute will be under the exclusive jurisdiction of the courts of the district of Brussels. The language of the proceedings shall be French.
